Mr. Manzilla and Ms. Dibartolomeo, our probate attorneys at Lucido & Manzella, are both Macomb County Public Administrators.  This is an appointed position that holds powers and duties in relation to the administration of the estates of deceased persons without wills and with no known heirs.  In this position, a public administrator also takes appointments from the Macomb County Probate Court to act as personal representatives in decedent estates where an impartial fiduciary is needed or where there are no known family members available or willing to serve. Mr. Manzilla and Ms. Dibartolomeo were both appointed by the Michigan Attorney General in 2018.

What Do You Need To Know About Probate?

Probate is not necessary for all assets a person may own. For example, property held in trusts or distributed by beneficiary designation does not need to go through probate. However, probate is necessary for assets distributed by a will. Depending on the size of your family member’s estate, you may have the option of simplified, or informal, probate.

If you need to become the caretaker of an elderly parent, we can also advise you if you need to be named your parent’s guardian. If your parent named you his or her agent under a power of attorney, you may not need to go through the guardianship process.
